1. Acceptance of These Terms

These Terms of Use (“Terms”) govern your access to and use of Goode Gardening, including its articles, photographs, photo journal, newsletters, downloads, and other content or services (collectively, the “Site”). The Site is owned and operated by Gabriel Goode (“we,” “me,” or “my”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Informational and Educational Purpose

The Site shares personal observations, experiences, opinions, photographs, and general information about gardening, plants, wildlife, food and drink, tools, projects, and related subjects. Content is provided for general informational and educational purposes only. It is not professional horticultural, agricultural, medical, veterinary, nutritional, legal, engineering, construction, pesticide-application, or other specialized advice.

Gardening conditions and results vary according to climate, soil, weather, species, cultivar, pests, products, techniques, personal health, and other factors. References to conditions in Maine or another location may not apply where you live.

3. Plant, Food, Beverage, Tool, and Garden Safety

Plant identification and edibility. Never eat, drink, touch, plant, harvest, forage, or administer a plant or fungus based solely on information or photographs from the Site. Independently confirm identity, edibility, preparation requirements, toxicity, allergen risks, contraindications, and safe quantities using reliable expert sources. Different species, cultivars, plant parts, ripeness stages, preparations, and growing conditions can present different risks. Keep potentially hazardous plants and materials away from children and animals.

Recipes, preservation, fermentation, and alcohol. Recipes and descriptions of preserving, fermenting, infusing, or making alcoholic beverages are general accounts, not guarantees of food safety or legality. Use current authoritative food-safety guidance, safe ingredients and equipment, proper sanitation, and lawful methods. Alcohol is intended only for adults of legal drinking age and should be used responsibly. Consider allergies, medications, medical conditions, pregnancy, and other individual circumstances, and consult a qualified professional when appropriate.

Chemicals, fertilizers, pesticides, and homemade preparations. Read and follow the current product label, safety data, application instructions, protective-equipment requirements, and all applicable laws. The label is the law for pesticide use. Homemade feeds, sprays, extracts, and other preparations can produce unpredictable results or cause injury, contamination, plant damage, or environmental harm.

Tools, structures, and do-it-yourself projects. Gardening tools, power equipment, ladders, trellises, greenhouses, water features, electrical systems, and construction projects involve hazards. Use suitable protective equipment, inspect tools and materials, follow manufacturer instructions and building requirements, locate utilities, and obtain qualified assistance when needed. Do not rely on Site content as a substitute for engineering, code, or safety advice.

Wildlife and pests. Wild animals, insects, plants, and control methods may present risks to people, pets, livestock, property, and ecosystems. Follow applicable wildlife, pesticide, trapping, and animal-control laws, and seek qualified assistance for dangerous animals, infestations, suspected poisoning, or urgent situations.

You are responsible for evaluating your circumstances, following product labels and applicable laws, and using tools, chemicals, recipes, plants, beverages, projects, and gardening techniques at your own risk.

4. No Guarantee of Accuracy or Results

We aim to provide thoughtful and accurate content, but the Site may contain errors, omissions, outdated information, or descriptions based on personal experience. We do not promise that content is complete, current, suitable for your conditions, or that you will achieve any particular result. You should verify important information before acting on it.

5. Intellectual Property

Unless otherwise identified, the articles, photographs, graphics, logos, designs, text, and other original content on the Site are owned by Gabriel Goode and are protected by copyright, trademark, and other intellectual-property laws.

You may access the Site for personal, noncommercial use and may share ordinary links to publicly available pages. You may also quote brief portions when permitted by law and accompanied by clear attribution and a link to the original page. You may not reproduce, republish, distribute, sell, license, scrape, systematically download, modify, create derivative works from, or commercially exploit Site content—including photographs or complete articles—without my prior written permission, except as permitted by law.

“Goode Gardening,” its logo, and related branding may not be used in a way that suggests sponsorship, endorsement, affiliation, or permission without prior written consent.

6. Permitted and Prohibited Use

You agree to use the Site lawfully and not to interfere with its operation or security; attempt unauthorized access; introduce malware or harmful code; harvest personal information; impersonate another person; use automated systems in a manner that burdens the Site; evade access controls; or use the Site or its content to violate another person's rights or any applicable law.

7. Third-Party Links and Embedded Services

The Site may contain links to, advertisements for, or embedded content from third parties. These are provided for convenience or context. I do not control or endorse every statement, product, service, policy, or practice of a third party and am not responsible for third-party content, availability, privacy, security, or transactions. Your dealings with third parties are between you and the third party.

8. Advertising, Affiliate Links, Sponsorships, and Free Products

The Site may display advertising, use affiliate links, accept sponsorships, or discuss products received without charge. If you follow an affiliate link and make a purchase, we may receive compensation at no additional cost to you. Material connections will be disclosed clearly where required. Compensation or receipt of a product does not guarantee a favorable opinion, and views expressed remain my own.

9. Future Products, Subscriptions, Consultations, and Events

If the Site offers products, plants, downloads, paid subscriptions, consultations, event tickets, or other paid services, additional terms presented at the point of purchase or registration—including descriptions, prices, shipping terms, cancellation policies, refund policies, and eligibility requirements—will apply. If those additional terms conflict with these Terms regarding the particular transaction, the more specific terms will control.

Unless expressly stated in writing, a purchase, consultation, or event does not create a fiduciary, professional, employment, partnership, joint-venture, or agency relationship.

10. Privacy and Email

Use of the Site is also subject to the Privacy Policy. If you subscribe to email communications, you may unsubscribe through the link provided in an email or by contacting gabriel@goodegardening.com.

11. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and all content, products, and services made available through it are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, completeness, currency, merchantability, fitness for a particular purpose, title, non-infringement, security, availability, or freedom from harmful components. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

12. Limitation of Liability

To the fullest extent permitted by law, Gabriel Goode and Goode Gardening will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, plants, crops, animals, property, or opportunities, arising from or related to your use of or reliance on the Site, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Your sole remedy for dissatisfaction with the free Site content is to stop using the Site. Any separate liability limits applicable to a paid product or service may be stated in the terms presented with that offering.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Gabriel Goode and Goode Gardening from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another person's rights.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Maine and applicable federal law, without regard to conflict-of-law principles. Subject to any rights you may have under applicable consumer law, disputes relating to the Site or these Terms will be brought in a state or federal court with jurisdiction in Maine, and you consent to that court's jurisdiction.

15. Changes to the Site or These Terms

We may modify, suspend, or discontinue any part of the Site and may update these Terms. Revised Terms will be posted with a new effective date. Your continued use of the Site after revised Terms take effect constitutes acceptance of the revised Terms.

16. Severability, No Waiver, and Entire Agreement

If a provision of these Terms is found unenforceable, it will be modified or severed to the minimum extent necessary, and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and any additional terms presented for a particular offering constitute the agreement between you and me regarding the Site and that offering.
